General Terms and Conditions

1. SCOPE  OF GENERAL TERMS AND CONDITIONS

The following terms and conditions apply to all offers, purchase and other transactions on the Tiny Lab site.  This site belongs to Lucas Ekdal with VAT number BE 0666.529.263. Present general terms and conditions can be consulted on the page http://www.tinylab.euThe use of the purchase channel on www.tinylab.eu.means the fully acceptation of the following conditions. Tiny Lab understands that when purchasing, the customer has accepted and read, without doubts, these general conditions. Tiny Lab invites all Customers to take note of the general terms and conditions by clicking on « I agree with the general terms and conditions » to continue the purchase. If you don’t agree, it will not be possible to proceed to the payment of your purchase. The fact the terms and conditions are not available in the Customer’s mother tongue, cannot lead to their non-invocability. The general terms and conditions are proposed in two languages (French/English). These Terms and Conditions are not applicable to purchases through other points of distribution than the webshop http://www.tinylab.eu.

To apply the present terms and conditions, we understand:

  • Tiny Lab: Tiny Lab proprietorship headquarters is established at Boulevard Léopold III, 17, 1030 Schaerbeek, Belgium and registered at the BCE under the number BE 0666.529.263.
  • Contract: the contract made up of present terms and conditions and the Order the Customer concludes via www.tinylab.eu
  • Personal data: all personal data from the Customer (name, first name, credit card number, invoice address, delivery address etc…) transmitted to www.tinylab.eu to allow them to carry out the order.
  • Login: the email address of the Customer when he registers. This email address will have to be completed any time he registers on the website.
  • Password: the personal and confidential password, chosen by the Customer when he registers and he has to introduce when Tiny Lab invites him to do so.
  • Price: the price of each product.  No VAT will be charged on the products sold on www.tinylab.eu since Tiny Lab applies the VAT exemption scheme, applicable to small companies (=Régime particulier de franchise des petites entreprises). For some occasions you may receive a discount voucher which grants you a discount on the final price of your order (shipping costs always excluded). lf you have several vouchers, these can't be combined.
  • Site: the internet website of Tiny Lab which address is www.tinylab.eu

2. MODIFICATIONS OF THE GENERAL TERMS AND CONDITIONS

Tiny Lab notifies the Customer that they reserve the right, at any time, to modify these terms and conditions. Tiny Lab notifies the Customer, that he will not be personally informed of possible modifications and it is up to the Customer to verify regularly on the website if modifications occurred, which will be announced on the homepage.

3. GENERAL CONDITIONS

ARTICLE 1: IDENTIFICATION AND PASSWORD

At the time of registration, the Customer has to chose an identification (email address) and a personal and exclusive password.  He is the only responsible for its confidentiality. He can at any moment change his identification or password according to instructions issued on the website. When placing an order, the Customer accepts that the data captured from the introduction of his identification and his password, constitutes valid proof of his identity in terms of delivery and billing information.

ARTICLE 2: ARTICLES AND ORDERS

 The distinctive features of each product are described on the appropriate pages of the website. Photo’s, product information, size, colours presented on the website, will be as look alike as possible, but cannot ensure the perfect resemblance with the presented product. In case of doubt, it is better to ask us before buying, we’ll be happy to help. Single inaccuracy, errors or omissions which could subsist in spite of all precautions, cannot be invoked.  Tiny Lab will not accept any claims with the motive of lack of satisfaction concerning the colour, the texture or the use of a material, which is not under the control of Tiny Lab. The special offers will be available when shown on the website and are subject to stock availability. Although Tiny Lab tries to have all the products always available in stock, the stock can exceptionally break. Indeed, Tiny Lab may occasionally have just sold an item which you ordered, and have not had time to take it off the site. In this case, Tiny Lab will reach you to see if you would like a substitution or just a cancellation. Additionally, Tiny Lab reserves the right not to fulfil any order of an item listed by error.

 Tiny Lab will not accept any orders:

  • from anybody under 18 years of age or not having legal capacity to sign contracts;
  • if Tiny Lab cannot define if the given address is correct.

The Buyer who wishes to purchase a product is obliged to:

  • fill in the identification form, with all personal data requested or to register if he already has a customer account;
  • fill in the online purchase order by giving all references of the chosen products;
  • approve his order after verification;
  • carry out the payment under specified conditions;
  • confirm the order and payment.

The order will not be processed until the moment the customer clicks on « I agree with the general terms and conditions» on the confirmation screen. The customer can cancel the purchasing process at any moment. Confirmation of the order involves full acceptance of the present terms and conditions, recognition of having full knowledge of them and renunciation of one’s own conditions of purchase or any other condition. Once the order is confirmed and the payment done, the customer will receive a message by email within 24h with the details of the amount paid and all products purchased. All data provided and the recorded order confirmation will constitute proof of the transaction. The order confirmation will be the equivalent of a signature and will signify acceptance of the operations executed. Customer agrees not to realize any false or fraudulent order. If we consider an order in this sense may be done, we have the authorizations to cancel it and inform authorities.

 

ARTICLE 3: PRICES

All prices mentioned on the website tinylab.eu will be the applicable price for the Customer on the day of the order. The published price only refers to the written description of the products. The matching pictures are used purely as illustrations and can contain elements that are not included in the price. The prices can be stated in Euro, Pound Sterling or USD Dollar, exclusive of the shipping costs. The shipping costs are determined during the buying process and communicated to the user, and depend on the total amount of purchased products, the chosen shipping method by the User and the country where the user lives. The final total price is explicitly and clearly stated before the Customer confirms its purchase. Tiny Lab has the right to change certain prices, including the shipping costs, at any moment whichever the motive, although there is an engagement to apply the published prices at the moment of the purchase by the User.

 

ARTICLE 4: PAYMENTS TERMS

Payment is due upon placement of order. The website tinylab.eu is subject to one of the most efficient security systems at this time and allows an optimal protection of all sensitive data linked to means of payment. Tiny Lab will never have access to any bank account information of the Customer. That is why all data will be asked at each new order. Payments can be carried out either by PAYPAL security system or by credit card, Bancontact, Maestro, MasterCard, Visa and several other bank systems. Tiny Lab cannot be held responsible for any consequences for using, illegal or not, the card by a third party, in particular in case of interception of messages.

ARTICLE 5: DELIVERY TERMS

 Tiny Lab will not deliver the products until we receive the confirmation of the payment. Tiny Lab delivers its products worldwide. The normal delivery time varies according to the postal service of the destination country.  The delivery indications available on the website will be given as estimates only. Neither Tiny Lab or the transporter can be held responsible for the inability to deliver or delivery delay in case of unforeseen and fortuitous events, adverse weather conditions or inaccuracy of the delivery address. In such a case, Tiny Lab cannot be held to any compensation payment at all.  Tiny Lab only assume responsibility for a shipment while the item(s) is/are in its possession. Upon delivery of the item to the transporter of choice, the risk of loss of the item passes upon delivery to the transporter. We will not be held responsible for lost or delayed shipments after delivery to the shipping. As a result, in case of delay, any damage, theft, etc. the client can only pursue the transporter. Tiny Lab will not be held responsible or liable in any way for its choice of shipping carrier. Depending on the amount of the order, Tiny Lab can send the products by registered parcel with acknowledgment of receipt. In that case, if the buyer is not present the day of delivery, a notice will be left from the transporter, with the address of the Post office where the parcel will be available during 15 days. Afterwards the parcel will be redirected to Tiny Lab headquarters in Brussels, Belgium. The buyer is held responsible to verify the conditions of the packaging and the content at the time of delivery. In case of claims concerning a possible defect or any sign of deterioration (missing product, damaged packaging, broken product,…) the buyer has to mention his observations accompanied by a picture by email to customer service info@tinylab.eu. Beyond this period, Tiny Lab cannot be held responsible for any complaint.

 

ARTICLE 6: RIGHT OF RENUNCIATION

According to the Belgian law, the Customer has 14 days to renounce to the purchase, without payment of a penalty en without justification as from the day the product was delivered. Complaints must be reported beforehand by mail to info@tinylab.eu. Tiny Lab will then provide the Customer with the address the products have to be sent back to. Costs and risks relating to the return of a product are the responsibility of the Customer. Because of the value of the products, it is highly recommended to the Customer to send the products by registered parcel with acknowledgment of receipt. The parcel and the product must be returned in perfect condition. The return of articles will be accepted only if the article has not been used or damaged and will be in same conditions as provided. The article must be packed in the original packaging and protected like it has been sent previously. All products will be conscientiously verified after receipt. Tiny Lab reserves the right to return any incomplete or not correctly packed parcels. All costs will be at charge of the sender. When the returned products will be received by Tiny Lab, Tiny Lab will proceed to reimburse the total amount, before 30 days.

 

ARTICLE 7: WARRANTY

We are confident about the quality of our products. However, there can be a defective or damaged product. Therefore, Tiny Labs commits itself to repair the defective product within the appropriate and reasonable limits. In order to invoke the warranty, the Customer must be able to show a proof of purchase. Therefore, the customer needs to contact the customer service department (info@tinylab.eu) after which the Customer will have to return the goods at his costs to Tiny Lab. The repair of an item doesn’t give the right of reimbursement. Every default needs to be reported within a month of detection. After which, every right for free repair or exchange will be voided. The warranty is never valid on gold-plated products or used by water, defaults that were created because of negligence, falls, abnormal or incorrect usage, use of the item for other purposes it is intended for, changes or modifications made to the item, hard-handed usage, bad maintenance, damage to the product due to an external cause (accident, choc, flooding…). It is also not applicable on items with a shorter lifespan.,In any case Tiny Lab will not be held responsible for the manufacturer to refuse to apply the guarantee for reasons mentioned above.

 

ARTICLE 8: RESPONSIBILITY

Tiny Lab cannot be held responsible for any delay in the execution of the order or non-performance of an order if the delay or non-performance is due to a technical cause or anything beyond its control. In that case Tiny Lab reserves the right to postpone the delivery within reasonable limits or simply cancel the order. Tiny Lab cannot be held responsible for the non-performance or bad execution of the contract which is attributable, either to the buyer or a third party to the contract, or in case of force majeure. Tiny Lab, in the process of online sales, cannot be held responsible for a damage resulting from the Internet network, such as a loss of data, intrusion, virus, breakage in the service, or other involuntary problem. The responsibility of Tiny Lab, whether in contract or quasi-delict, is limited to the reimbursement of the price of the order and cannot lead to any other compensation.

 

ARTICLE 9: PERSONAL DATA

The Customer commits himself to communicate all necessary data for the fulfilment of the order and for any other marketing operation without usurping the identity of another person or to use a false name. Therefore, Tiny Lab cannot be held responsible for any possible errors or inaccuracy in the delivery address details from the buyer. Tiny Lab is committed to protect the privacy of the internet user, who surfs on its website by ensuring confidentiality of personal information. Tiny Lab informs the users that all the personal data and all information about customer purchases are kept in electronic format in a file, created and maintained under Tiny Lab responsibility. It will not be ceded to third parties, except in the cases provided by law. The personal data will be used to manage provided services, orders, administrative tasks, to send technical information to customers, or commercial adverts by email or ordinary mail. The Customer also agrees that we can use this data to contact him if necessary. For any doubt about that, or to use your right of opposition, rectification or cancelation of your data you can contact us at info@tinylab.euBesides, we collect anonymous cookie information about the site pages and items the Customers view. This is not used with personally identifiable information (such as the name and address the Customer gives us when his places an order), but as aggregate information  that helps Tiny Lab learn more about how people use and react to its site. Tiny Lab stores information about the items the Customer adds to his cart so his cart selections are not lost between visits, but will not know who placed the items in the cart unless the Customer send an order. It is recommended to the buyer to communicate also a phone number where he can easily be reached.

 

ARTICLE 10: LITIGATION RULES

Present online terms and conditions are subject to Belgian law. Parties will seek before any contentious action, a friendly agreement. The search for the friendly agreement does not interrupt the ‘brief’ delay of the legal guarantee. Any dispute or litigation is solely under the exclusive jurisdiction of the Brussels courts.
